Website & General Terms of Use

These Terms of Use ("Terms") govern your use of the website www.PrietoEngineering.com (the "Site") and general inquiries made to J.F. Prieto Engineering Construction, Inc. ("JFPEC," "we," "us"). By using the Site or contacting us, you agree to these Terms. Construction services themselves are governed by our written proposals, contracts, and Standard Terms and Conditions — not by this page.
1. About JFPEC
JFPEC is a California-licensed general engineering and building contractor (CSLB License #525452, Class A and C-8) serving commercial, industrial, municipal, and private-sector clients. Our services include concrete construction and masonry; asphalt and pavement maintenance; civil grading and earthwork; underground utilities; demolition; commercial tenant improvements and general construction; ground-up general contracting and real estate development; facility maintenance; and emergency and rapid-response services.
2. No Offer; Estimates and Proposals
2.1 Content on the Site — including service descriptions, project photos, and any pricing references — is for general information only and is not an offer, quotation, or commitment to perform work.
2.2 Budgetary figures discussed by phone, email, or in preliminary conversations are good-faith estimates only. JFPEC is bound only by a written proposal signed or accepted in accordance with its terms, together with JFPEC’s Standard Terms and Conditions.
2.3 Unless stated otherwise on its face, a written JFPEC proposal is valid for thirty (30) days from its date. The latest issued version of any proposal supersedes all prior versions in their entirety.
2.4 Site visits, walkthroughs, and plan reviews performed to prepare an estimate do not create a contract and do not obligate either party to proceed.
3. Communications
3.1 The official channel for project communications and document delivery is projects@prietoengineering.com. Please direct proposals, plans, bid invitations, and contract correspondence there.
3.2 Text messages, voicemails, and conversations with field personnel are welcome for coordination, but they do not constitute notice to JFPEC and cannot change the scope, price, or schedule of any project. Direction affecting scope, price, or schedule is effective only in writing from an authorized representative.
3.3 Submitting plans or project information to us does not create a confidential or contractual relationship, though we handle client information with care and treat executed-project records as confidential business records.
3.4 We aim to respond to bid invitations and inquiries promptly during regular business hours. Emergency and rapid-response service requests should be made by phone at (800) 606-3880 ext. 1.
4. Services, Changes, and Payment — Summary
The following summarizes standard practices that apply to JFPEC projects; the full provisions appear in our Standard Terms and Conditions and in each contract:
- Scope is defined by the written proposal’s Scope of Work, Inclusions, and Exclusions. Anything not expressly included is excluded.
- All changes require a written, signed change order before the changed work begins. We do not accept oral change directives.
- Client-facing pricing is lump sum (or stated T&M rates). Internal cost data, rates, and markups are confidential and are not provided.
- Invoices are progress-billed and due net 30 unless the contract states otherwise; late amounts may accrue a service charge as permitted by law.
- Workmanship is warranted against defects in materials and installation for the period stated in the contract, subject to the warranty conditions and exclusions stated there.
- Hazardous materials work, permits and fees, subsurface investigation, dewatering, and traffic control plans are excluded unless expressly included in a proposal.
5. Site Content and Intellectual Property
5.1 The Site and its content — text, graphics, logos, photographs, and project imagery — are the property of JFPEC or its licensors and are protected by applicable law. You may view and print pages for personal or internal business reference; any other reproduction, distribution, or commercial use requires our written permission.
5.2 JFPEC trademarks, logos, and trade names may not be used without written consent. Project photographs may depict work performed under specific site conditions; they are illustrative and not a representation of results for any other project.
6. No Professional Advice
Site content and general correspondence are not engineering, architectural, legal, or code-compliance advice for your specific property or project. Conditions vary by site and by jurisdiction; requirements are determined by the authority having jurisdiction for each project address. Consult qualified professionals, and rely only on documents JFPEC issues for your specific project.
7. Disclaimers and Limitation of Liability
7.1 The Site is provided "as is" and "as available." We do not warrant that the Site is error-free, uninterrupted, or free of harmful components, and we may change or remove content at any time without notice.
7.2 To the maximum extent permitted by law, JFPEC is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Site or from reliance on general (non-contract) information. Nothing on this page limits rights or remedies under an executed construction contract or that cannot be limited under California law.
7.3 Links to third-party sites are provided for convenience; we are not responsible for their content or practices.
8. Licensing and Consumer Notice
Contractors are required by law to be licensed and regulated by the Contractors State License Board (CSLB). JFPEC holds CSLB License #525452 (Class A — General Engineering; C-8 — Concrete). License status may be verified at www.cslb.ca.gov. Any questions concerning a contractor may be referred to: Contractors State License Board, P.O. Box 26000, Sacramento, CA 95826.
9. General
9.1 These Terms are governed by California law. Any dispute arising from use of the Site shall be brought in the state or federal courts located in Los Angeles County, California, except that disputes under an executed contract follow that contract’s dispute resolution provisions.
9.2 If any provision of these Terms is unenforceable, the remainder continues in effect. We may update these Terms from time to time; the version posted on the Site is the current version.
