Malibu Septic Rules for Home Sales: Operating Permits, Transfers and Inspections

Malibu runs its own septic program. An operating permit is needed when a home on septic is sold, and the buyer files a transfer within 30 days of the change in ownership. If the system fails a City-registered inspection, the owner records a compliance agreement and the permit issues once repairs are done.

Malibu runs its own septic program, separate from LA County. If you are buying or selling a home on septic inside city limits, the City's operating permit rules shape the timeline. This is an overview of how the program works, based on the City's published pages.

The operating permit

The City requires an operating permit to build and run a new septic system. For existing systems, a permit is needed when a property is sold, when a septic permit is issued for a repair, or when the property gets a short-term rental permit. Commercial and multi-family systems carry renewable operating permits.

The City lists these validity periods:

  • Residential conventional systems: 5 years
  • Residential advanced systems: 3 years
  • Commercial, multi-family and home occupation use: 2 years

An operating permit application needs an inspection report completed by a City-registered OWTS inspector. Septic practitioners working in the city, including designers, installers, inspectors and maintenance providers, have to register with the City.

When a home changes hands

  • Within 30 days of a change in ownership, the purchaser submits a Transfer of Operating Permit application.
  • If no permit or certificate was secured before the sale, the new owner has 180 days from the purchase to secure an operating permit.

If the system fails inspection

When an inspection on a property changing hands finds that a repair, alteration, upgrade or replacement is needed, the City's point-of-sale process applies:

  1. The registered inspector submits the inspection report to the City.
  2. The owner signs and notarizes a compliance agreement within 30 days of the failure date and records it within three to five business days.
  3. The City issues a certificate within 45 days of the failure date.
  4. The operating permit is issued once all the required repairs, modifications, replacements or upgrades are done.

What slows Malibu sales down

In our experience, it is usually access. Buried lids, pits nobody has opened in years, and steep or tight lots all take time to expose. Starting the inspection early in escrow leaves room to locate components and to price any repairs before the deadlines start running.

Where we fit

We locate, expose, pump, inspect and repair septic systems across Malibu and the Santa Monica Mountains, and we install and service ORCA Pod treatment, made by ORCA OWTS. Design work comes from a qualified designer, and we build to the approved plans.

The City updates its program pages and fee schedule, so confirm current requirements with the City of Malibu before you rely on a date.
